Fiscal Sponsorship
1. DESCRIPTION
The Conseil des arts de Montréal's (CAM) fiscal sponsorship allows artistic organizations that meet the CAM's eligibility criteria to solicit donations from foundations, corporations and individuals; they, in turn, will benefit by receiving tax receipts. The CAM acts as an intermediary which, having vouched for the artistic, administrative and structural quality of the arts organizations, will distribute grants from foundations, corporations and individuals to them.
Fiscal sponsorship is part of the General Financial Assistance Program for Arts Organizations and is for arts organizations that do not have a registered charity number and whose headquarters are located on the Island of Montreal.
2. OBJECTIVES
The fiscal sponsorship aims to achieve the following goals:
- to support high quality, artistic creation projects;
- to enable arts groups to produce their activities and projects through the diversification of their sources of revenue by seeking donations;
- to offer donors a guarantee of the seriousness and sound management of the artistic projects and the companies producing them, and to enable donors to receive tax receipts.
3. ROLE OF THE CONSEIL DES ARTS DE MONTRÉAL
As a service organization serving the city's arts community, the Conseil des arts de Montréal supports and recognizes excellence in professional artistic creation, production, and dissemination, providing financial support, guidance, and activities that promote dialogue and development.
The Conseil des arts de Montréal, a public corporation, is recognized by the Canada Revenue Agency (CRA) as a registered charity (RC) and it has the power and mandate to fund non-profit cultural organizations, whether or not these companies are registered charities.
The Conseil des arts de Montréal does not undertake fund-raising for arts organizations, but makes it possible for companies, having identified potential donors for their activities, to derive benefits from donations.
4. ELIGIBILITY CRITERIA
All organizations submitting a request for fiscal sponsorship must first meet the following criteria:
Legal Status
- must be a duly constituted non-profit corporation operating for at least one full year;
- must have had its headquarters on the territory of the Island of Montreal for at least one full year;
- must have a board of directors composed, in majority, of Canadian citizens or permanent residents living in Canada;
- must have, as its principal mission, the creation, production and dissemination of arts activities;
- must not have a registered charity number.
Professionalism
- have a recognized level of competency and be able to demonstrate it;
- must be managed by qualified persons;
- must present activities whose artistic quality is recognized by its peers;
- must gather together, represent, or employ professional artists1.
1Professional artists are those who have acquired basic training, possess a competency recognized by their peers, create, perform, or publish works to be presented within a professional context, are dedicated mainly to the practice of their art, and who receive remuneration for the work they produce.
Artistic Disciplines Funded by the CAM:
- circus arts;
- dance;
- film;
- literature (including cultural periodicals and storytelling);
- media arts;
- music;
- new artistic practices (multidisciplinary and interdisciplinary);
- theatre;
- visual arts (including architecture, design and fine crafts).
Ineligibility
The following are not eligible:
- individual artists;
- artists' collectives;
- organizations in the fields of variety shows and song;
- requests for activities previously or currently being produced;
- public organizations, para-public government organizations and municipal corporations.
5. SELECTION PROCESS
N.B.: We recommend that organizations communicate with the advisor responsible for fiscal sponsorship in order to obtain all of the relevant information before submitting a request.

5.1. Submitting a request by an artistic organization
|
|
|
Any organization wishing to submit a request for fiscal sponsorship must do the following:
- complete the application form (Word document)
- complete the detailed 2008-2009 form (Excel document), according to the type of organization:

- must agree to allow the CAM, in the eventuality of a favourable response, to withhold a 3% administration fee on donations received.

The application deadlines for fiscal sponsorship are as follows:

Decisions will be communicated one week after the general meetings of the Conseil des Arts de Montréal board members. These meetings take place four times per year.
6. EVALUATION OF THE APPLICATION

6.1 Preliminary review and verification of eligibility;
|
|
|
6.2 Review of cultural and financial aspects by CAM's cultural advisors:
|
|
|
The main evaluation criteria are:
|
- Artistic quality
- The presence of a strong and original artistic direction;
- The relevance of the mandate;
- The artistic quality of the organization's past achievements and projects;
- The consistency of the activities in keeping with the group's mandate and artistic orientation.
- Enhancement of the discipline and audience development
- The original contribution of the organization to the artistic development of its sector;
- Efforts made aimed at increasing the organization's visibility among the various audiences across the Island of Montreal (i.e. level of integration in the milieu through awareness activities, tours and other development projects aimed at increasing audiences) and, depending on the organization's mandate, its national and international reputation;
- Recognition from the arts sector and the public.
- Administrative and Financial Stability
- The organization's ability to manage its activities well and to bring its projects to fruition;
- The stability of its financial situation;
- The capacity to collaborate with various partners in the arts sector;
- The organization's stability and sound governance;
- The level of the company's revenues from independent sources and the diversification of its funding sources.
NB: CAM must be sure that there is no arm's length relationship between the donor and the organization, and that the donor will not benefit personally from the donation.

6.3. Review and recommendation by the members of the sectorial committee;
|
|
|
6.4. Final review and approval by the members of the Conseil des Arts de Montréal during a general meeting.
|
7. ADMINISTRATIVE PROCESS
Once the application has been reviewed, the Conseil des arts de Montréal will communicate, by mail, the decision of its members regarding the request for fiscal sponsorship.
When the project has been accepted, CAM will undertake the following:

- open an account and keep thorough records of the donations received within the fiscal sponsorship program. Donors must make their cheque out to the Conseil des arts de Montréal and clearly specify which organization and/or project the donation is for;
- receive the donation on behalf of the organization, keep a 3% administration fee
- emit cheques and tax receipts. It is understood that tax receipts will only be issued for donations of $100 or more, i.e. not for donations given in exchange for goods or services. Donations in the form of goods or services cannot be accepted within the Fiscal Sponsorship Program.
- ensure that the funds are being used for the CAM’s charitable purposes, by following up on the organizations and requesting reports, a summary and periodic financial statements from each of the beneficiary organizations.
- in the eventuality that the organization disregards the conditions of the grant or program, the CAM can terminate the organization’s participation in Fiscal Sponsorship and, if there are funds that have not yet been given to the defaulting organization, those funds will be subtracted from the program while remaining the property of the CAM.

The artistic organization will send CAM a balance sheet and financial statements.
Any new fiscal sponsorship project requires a new application.
